A business woman, Mrs Temitope Olagoke, last week, at an High court sitting in Ibadan, won a 14- year legal tussle against one of the first generation banks in Nigeria. Tunde Ogunesan who has been monitoring the case  for some time, brings his report.

FOR Mrs Temitope Olagoke, nothing could best describe her feelings than a tear of joy last week when Justice Enny Esan affirmed her earlier ruling on the case of Temitope versus First Bank Plc, as she burst into tears. For over 14 years, Mrs Olagoke had engaged the bank in a legal tussle over an alleged illegal deduction from her account domiciled in one of the bank’s branches in Ibadan, as a distributor with the Consolidated Breweries Plc.

Justice Esan, on June 19,2012 at Court Seven of Ibadan High court upheld her earlier judgment of April 17, 2012 that the defendant deposited the sum of N2,00,344.77 kobo (Two million, three hundred and forty-four thousand, seventy -seven kobo) “plus whatever should have accrued to the claimant in her savings account passbook which is till in possession of the defendant” to the chief registrar of the High Court within 21 days. Olagoke’s travails began around 16 years ago when she opened an account with a branch of the bank at Dugbe, Ibadan. Thirteen months after, she requested for her statement of account which the branch was unable to produce.

The matter according to her was brought to the notice of the bank’s regional head office at Segilola, old Kingsway, Ibadan. The regional head office intervened and ordered that she be furnished with the details of her account statement.

The effort to release Olagoke’s statement of account eventually led to a legal battle which eventually got to its peak last week. In an interview with Crime and Security, Mrs Olagoke eulogised the judiciary which she said had saved her from total wreck. According to her “My business had collapsed due to this case. But I thank God that I’m alive today and the bank’s management would also know that I was

never out to destroy their business. All what I want now is for them to obey the court ruling, so that I can bring my life back on track.

“I saw hell during the last 16 years but I want to appreciate the judiciary for restoring my hope of living and even giving life to my business even if it’s in a little way. I’ve lost so many things while this case lasted. I cannot thank the judiciary enough.

“Please help me appeal to First Bank Plc, they should return my money and my Certificate of Occupancy (C of O). I want to pick up from where I left, my business is not as it was before,” Olagoke appeals.

Babatunde Lasaki of the First Bank Plc in his reaction said, “As you already know, the case is in court and the bank had made several appearances. The case is still in court. We cannot afford to say much else we are charged for contempt,” he said.

Poor reporting. Anyone who has not been consistent with this case for the past 16 years, wouldn't be able to make sense out of this story.
